Statuatory Rape ?

What is the name of your state? TX

I am looking to find information on the statute of limitations on filing statuatory rape. I also am wondering if this is worth the trouble of filing. My boyfriend was 16 and a 21 year old woman slept with him. This resulted in a child that he is now paying child support for but he has no visitation rights. I am wondering if he files statuatory rape if he can get these child support payments taken away?
Any information would help. We have no idea where to start.

The age of consent is 17 years of age in Texas. How old is your boyfriend now? Why was this woman not prosecuted at the time of the rape?

In any event, I do not believe the Texas statutes make a differentiation on how or why the child was conceived; only that it was conceived.

Since child support is the right of the child and not of the parent, then the child produced by a rape should be eligible for child support as well as a child produced by a consensual sex act.
