Buyer falsified home inspector's report

Dear Atty.Martin:
My buyer put my real estate agent and us through the mill! He put down a $10,000 deposit on our home; and then falsified a home inspector's report from a basement specialist co., that came to inspect a sump pump in our cellar. The home was built in 1999; and the builder put it in as an added precaution - we didn't and don't have water problems. Well- he put the company logo on his letterhead and faxed a fake report complete with the transposed signature of the home inspector's signature!!!!!!( The report had me so nervous -- structural, legal problems with drainage on the neighbor's yard- all lies) that I called the co. and they emphatically denied that this was their report. I confronted the buyer, who faxed back and admitted his ruse. Do we have to give him the deposit back-- we'd rather not!! Please respond A.S.A.P Thanks, [email protected] our state is MA.

What are the Buyer back-out contingencies in the contract? Why would a Buyer do this?
If the earnest money is in escrow, sent escrow a certified letter that there is an ongoing legal dispute and they are not to release the funds until the matter is resolved.
