We have a question about adverse possession. 10 years ago we purchased a piece of property from a
contractor who split a large lot in two. We were shown the property lines, and with his help, built a
house & sold it to Sue. (He also built a house on his lot, with our assistance). We built a retaining
wall and fence for Sue on her side of the property line, which Sue maintained and paid taxes on.
Now, 10 years later, the neighbors had a survey and found the property line to be wrong. The
retaining wall & fence is actually on their property. However, all parties purchased their properties believing the line & shown surveyor stakes to be correct. Now the neighbors are suing everyone. Us,
Sue, the developer, the title company, etc. They are asking for more than we paid for the entire lot.
Is the a way that Adverse Possession could apply? How can we find out?
