We entered into a Contract For Deed 4/15/1998, with a small land company for the purchase of 76.39 acres here in Texas. The Land Co. breached the contract 1 year after we entered into this with them. They have repeatedly failed to respond to us via phone or in writing. Then we entered into a Chapter 13 Bankruptcy but due to plan pmts. being too high it was dismissed March 29.2005. We are out of Bankruptcy now. However, this Land Co. had their Atty. submit an altered and forged contract as a true and correct copy to our Federal Bankruptcy Judge who ruled against us on this fraudulent document. We have a copy of this altered document. Then we met the terms of curing a default to prevent them for appearing before the Judge to get the Automatic Stay lifted by a Bank Wire transfer made to them by our perspective buyer of the land. The Land. Co. would take so long to get us the pay off the perspective buyers backed out citing a shady Land Co. The sell of the land would have not just paid it off but it would have allowed us acreage to live on and retain as our part of the sell. The sell also would have allowed us to be compensated on occasion for land upkeep. The land Co. caused this deal to fall thru and created a major hardship for us. We now have been unable to get the 2004 Int. Stmt. from them to file with our tax return. Now we are back in default on payments no ability to pay it off no one wishing to buy it now and the Land Co. breached the contract, committed fraud, negligence, forgery, bad faith, deceptive trade practices and should be liable for Punitive Damages as well. They now are trying to foreclose on the land and have violated us so badly. One they failed to meet their own Contractual Obligations it should appear they voided the Contract once they Breached the Contract therefore no valid contract to execute on. How can we sue them for all of this by June 20, 2005, or get an injunction filed to stop them until this can be taken into court? Since we are now both disabled how can we get this taken on a contingency basis? It would seem due to more than 1 deceptive trade practices act violations which in TX is triple damages and we wish to sue for the full financed contract amount of over $200,000.00, plus add to that all the other violations of law there should be someone willing to take on a case of this magnitude. I am even willing to help if I can in anyway possible. If this Land Co. is able to foreclose on us we will become homeless. Can we inform them of our intentions and see if they want to make an out of court settlement? Can we self represent ourselves on this if we cannot get an Attorney? If we can self represent ourselves how do we go about doing so and getting an injunction filed before June 20, 2005?
