We sold out home recently (it closed Oct 31st), and then my husband's mother(89) started having medical problems. We realize we can't leave the area, while she is alive. As it is she lives 1 1/2 hrs away, and my husband is having to go nearly every week to take her marketing & to pick up prescriptions. We have till Jan 31,2001 to vacate. Is there anyway to cancel the sale? We are willing to recompense the buyers.

My response:

Unless the buyer is agreeable to a settlement, then the answer is no. Your problems aren't the buyer's problems. You signed a contract, and that's what contracts are for - - they are not signed so one of the parties can "back out".

As such, the buyer could sue you for Breach of Contract, and Specific Performance, and Damages. Oh, and the buyer would win.
