I recently retired and bought a house on 5 acres. I just found out that the owner next to me has proposed plans submitted to the county to sub-divide 100 acres to 1 arce parcels. He claims he has easement rights thru my driveway, even though his encroachment is some 100 feet south of my driveway. He says that he's been using this easement since '93, however, I learned that he had leased the land to cowboys that used the gate to feed their cattle. Now he's changed the use for realtors to show parcels(?). There's nothing recorded with the county and my title insurance cites no easement rights other than to the utility company. I wrote a letter advising him I was adjusting my fence accordingly so he wouldn't be able to use my driveway. He threatened that he's getting a restraining order prohibiting me from blocking his access.
