Towing ticket

Can someone please provide any legal advice on the following situation? My wife had her vehicle in a strip mall parking lot, where parking spaces are shared by various businesses. She was parked in establishment B's lot, but was actually in establishment V.
As a message came over the speaker in business V that vehicles were being towed from B's parking lot, she went to check if her vehicle was ok. It turns out the towtruck
was ready to hook her car and tow. She asked the tow company what the charge was, and was told 50$. She explained to the tow driver that she needed to walk 1/2 block to the ATM to get the cash, as that is all they would accept. By the time she got back, they had towed the car, and now are asking for 140$. The police told her it was illegal for the tow company to demand any money, so she wouldn't pay when she picked the car up at the lot. The owner of the tow company agreed, but said it was legal for him to sue. Does anybody out there know if he can legally sue?

Most people don't sue for $145 and if they do, she can tell the jugde or arbitrator and the arbitrator will knock it down.

If the two company operated illegally in theh first place I can't see what they would be suing for.
