Is it possible to get a traffic ticket that was issued, by the state police, in one county, moved to another county closer to my home? Is there a change of venue for speeding tickets? I figure the cop won't drive two hours to convict me.

My response:

Here's a motion that, with some massaging by you, will do the trick.

Out of County venue changes?

I realize this is an old posting but after reading it and the V.C. Section it refers to, it is my understanding that the venue change must be made to the county seat of the county where the infraction took place.

I received my ticket at Baker in San Bernardino County and the ticket has the court as Barstow. I would like to get it changed to LA County but 40502(b) refers to changing to San Bernardino, the county seat of San Bernardino.

Should I request LA County and risk it being denied or should I request San Bernardino?

I can guarantee you it will be denied. We don't accept transfers out of the county, nor do we transfer out of the county (and I work at the county seat).

I figured that...

I figured the V.C. clearly stated it must be within the same county but the 2nd poster seemed to infer otherwise. Thanks for clearing the matter up.

On a related matter...

State=California

I've searched the internet and the CA DMV web site but I have not been able to find the answer. Is there a specific form to use when requesting the change or will the above letter (with appropriate changes) be sufficient?

You can't transfer from one county to another. You can only request it be transfered to the county seat if you live/work closer. Normally the request has to be made at the time of the stop but you can try. The above letter is good.

Silly rabbit. Of course you can. It is done any time a defendant can demonstrate that he will not be able to receive a fair trial in the county of origin - because of pre-trial publicity, etc.

Penal Code 1033 and Rules of Court 4.150.

Good luck,

Pug

Since I am not an attorney, how do I fill in the name/address header?
Do I write Propia Persona (Pro Per) or something else?
If I mail it myself, can I delete the "person who is mailing it" paragraph?
Thank You,
Bright Skies:)
