rock from gravel truck hits winshield

While my wife and I were on the freeway, a small rock came from the back of a gravel truck hitting my winshield causing about $260.00 in damage to replace it. Of course the driver of the truck would not pull over, so I wrote down all identifiable info and filed a police report with the CHP. I receieved a letter from the vehicle's owner indicating he will not pay for my damages. Is there any written documents that I can use as to support my small claims suit besides my wife and I witnessing this.

My response:

About three years ago in California, this exact issue came up for a General vote (it was one of the Propositions). The proposition concerned whether or not trucks like the one that "threw a rock" should be required to have covers over their loads. Guess what? It got voted down.

There is nothing more, that I can see, that you can do except testify that he did, and he'll say he didn't. The classic "he said, she said." However, if you have Comprehensive coverage on your vehicle, use that instead.
