If anyone can help me, I'd greatly appreciate it.....
I was driving down a very narrow road (in the rain) with no lines in it....the roadway is approximately 16-17 feet wide, with no shoulders or curbs....
This guy comes barreling up behind me and attempts to pass me, but an oncoming car prevented him from doing so...
He THEN passes me on a 45-degree turn on the same road, after tailgating me! As he passed, a minivan is coming in the opposite direction....me and the minivan brake hard as he swerves between us....if we didn't brake, a three-car accident would have occurred.
(I had a baby in the car, and since this guy almost killed us....I obtained his plate # and filed a careless driving charge against him.)

He, in turn has issued a ticket against me for "failure to allow passing."

HERE'S MY QUESTION: Even though there were no lines painted in the road, did he have a right to pass me on such a narrow road? Are there any laws stating that the road needs to be a designated number of feet wide to allow passing?

If anyone can help...I'd be grateful!

Your defense was that he was reckless and tailgating and that you did not feel it was safe to pulll over and stop. In some states you have a duty to pull over to allow others to pass when a few cars are behind you, but I never heard of a driver behind you being able to ticket you.
