My response:

Now, how in the world could I refuse to give you an answer with such nice words like those? I would go the end of the world for you - - well, just to the end of this post. Some people here just love me, some people would just love to "string me up." Some like my humor, some would just as soon cram it down my throat. Oh well, to each his/her own. I am who I am. With all sincerity, I had no idea you posted because yours was at the end of someone else's answer, and I never thought to look again. Everyone on this site is really good; especially Lars Coltrane, ALawyer, Tracey, MsAttorney, and many others, and yes, I have to admit it, even LAWGUY -- who hates me with every breath he takes and with a passion - but from a legal standpoint, he's really very good (Can't take the "niceness" can you Lawguy?)

Anyway, here's the best I can do for you.

You said:

"I am in the same boat. 12/95 and 2/96 I recieved tickets for past due registration and driving on expired licence 12/95 (officer added a few, seat belt, cracked window etc). I have never taken care of these because of finances and then fear I would be arrested.

"Is the statute of limitation on the ticket itself?

"If the D.A. can't prosecute and the collection agency can't collect, can the DMV in CA not allow you to get a new licence?

"I went to the DMV was told to clear ticket with collection agency, can't afford to. How can I have the tickets removed from the DMV file?"

My response:

All the DMV knows is that there's an outstanding fine that must be cleared before your license can be re-issued. The DMV cares not one iota if a Statute of Limitations has run, or not. All they see on their green computer screens is an outstanding problem.

Here's what you do. I would contact the collection agency, in writing by Certified Mail, Return Receipt Requested, and inform them if they fail to stop collections, and fail to release the fine, you will sue them for your damages. As a matter of fact, contact an attorney for a consultation in your area for full details and, for a small charge perhaps, that attorney will write a letter to the collection agency on your behalf. That might get them to back off REAL quick.

Thanks again for your nice compliments, not just for me, but for everyone else on FreeAdvice !!

Good luck to you.
