I am going for round 2 in my fighting of a traffic ticket, for being the last one through on a left turn, on a busy Detroit area street. I read that the police are not allowed to park on private property to watch for violators, the office said at the first informal hearing that he was parking in a bank parking lot. If this was really unconsitutional, how could I prove it when I return for my formal hearing on April 13. I appreciate your time, thanks -

My response:

Since you already have the officer stating that he was on bank property, just find the case, or the statute, that says what you are saying. When you do, and it says exactly as you understood it to mean, then throw your copy in the cop's face.

Being against practice or code is not necessarily unconstitutional - there is a big difference. Also - is a bank parking lot private property - where public use is granted? May be an issue you follow up on even if you do find info that bars police from doing their work from private property.
