Is there an agency that can state that atlerantive tests for DUI FST's are viable? As an example: ABC's (?) or head tilt, hand to nose test? A jury was hung up on the viability of these alternate tests as the officer said that he doesn't use them, even though he knew the victim (defendant)stated she had a very sore foot (long standing problem heavily documented by her doctors over the past year +) and was going to try to do the test. Hindsight is 20/20, she should never have said she'd try, he said he took that as she could. He was awarded an honor at the MADD in Tallahasse last year for the most arrests in DUI charges. Other than being overzealous, society tends to err in favor of the officer's word. I need proof that the alternate tests are viable and should have been administered if she wasn't to be discriminated against for her handicapp. Help!
