IAAL-My notice to appear says my court date is 5-30-00 at 830A. I filed my motion for a verified complaint on 5 May, along with my $23 filing fee. On 15 May they sent me a letter saying I need pay the full bail amount to set up a court trial. So I sent in a check for another $81. Yesterday, they sent me another letter saying that my court date is 830A on June 23.

1. I am prepared to go to court on the original 30 May date, but I will be out of town on the new court date of 23 June. How do I go about getting the new 23 June date changed to one where I know I will be in town? I want to get the court appearance done ASAP. Should I show up in person on 30 May to settle this with the clerk?

2. They obviously received my $23 check but they never returned the copy of the facing page of the motion in my SASE. What issues does this cause? Can the judge just say "We never received your motion?" Should I press the issue with the clerk to get a confirming copy sent to me?

Thanks for your advice,

WOTF

<<Okay, this should be relatively painless. The court continued your matter Sua Sponte ("On it's own motion"). Call the Clerk, and ask for a continuance of the continued date. Explain that you've already paid for non-refundable tickets to somewhere. The trial dates are set for the court's convenience.>>

<<While not absolutely necessary, it is nice to have a conforming copy. When you call the Clerk, ask about your copy and if the original was filed. If so, get him/her to send you a copy of the face page. If not, get the clerk's name and send another face page directly to that Clerk for conforming. Get a copy of your cancelled check for proof of payment.>>

<<Go get 'em, and please let us know how it turns out.>>
