I'm trying to help my daughter. She left her boy friend of over 10 years. He is now trying to hold all her belongings demanding that she return an engagement ring in return. Her boyfriend is using his boss as a mediator and both have a short fuse. All my daughter wants to do is take her belongings out of the apartment that they shared but leased only under his name. He has changed the locks and has told her she cannot have her things until he gets his ring back. At one point they said she could start taking things out. But only when they were available. She wants her things out of the apartment and doesn't feel she should have to give the ring back. She has paid many months of rent by check but was told this doesn't matter because her name isn't on the lease. So the landlord is telling her he can't help her because the lease is under his name. This guy has really taken advantage of her and has made her pay for most of their expenses while he stockpiled his money. The boyfriend will be moving out and the lease will be over on the 20th of June 2005. My question is what should she do now? I do not want her arrested for trying to take her own things from the apartment. But I do believe she is entitled to go get her things. I was told he has all the things out of his that he wants so there is no reason to have changed the locks so she can't get in and get her things without him. Will my daughter have to go to court to get some type of permission to enter the property and retrieve her belongings? Not sure what to do. I believe that her boyfriend of over 10 years owes her more then just a ring. I believe that they should split half of all their belongings just like they were married. Not sure that is the case in the State of Nebraska. My other question is. Can my daughter claim they were married by the length of time they were together and ask for half of his belongings as a settlement in this separation?
Thanks for any help anyone can give.
Frank

She needs to ask for a police escort to go to the apartment to retrieve her belongings.
