Serving alcohol to a minor

A server in a restaurant in Minneapolis, MN does not check a patrons ID and serves him alcohol. The patron turns out to be a minor and part of a Police sting operation. Who should be held responsible for this act; the server or the establishment? The server maintains that he was never trained to ask for ID. The establishment says that this was only his 3rd day on the job and so he hadn't been fully trained yet. The Police charged the server without any consequences for the establishment whatsoever. Is that "legally" correct?

**A: yes, but the establishment holding the liquor license is also liable.
