What is the name of your state? NY

Good afternoon. We live in Texas now, but while in NY my husband received an ACD (not drug related) back in 2001 that would have caused the original charge to be dismissed in early 2002 (six month period). Here is our question. He is applying to a police force here in Texas and during the application process questioned whether he had ever been 1. arrested or detained, 2. convicted of a felony, misdemeanor or dui, 3. fingerprinted. He admitted to having been arrested as it would have come up during the polygraph test, but now the investigators at first glance are contemplating whether to consider this a conviction. What do I need to do to prove to them otherwise - that NY law states this is not an admisssion of guilt or a conviction? Or am I misled altogether?

Their requirements are the following:

*No Felony or “Class A” misdemeanor admissions or convictions
*No “Class B” misdemeanor convictions within last 10 years

I appreciate your time and advice in this matter.
