A storm blew one of our oak trees down. Minimal damage, except that it did do some minimal damage to the buisness next door to us. Our insurance did not cover the damage to the buisness.
The buisness owner was very understanding, and said not to worry. Then we get a letter from his insurance company wanting over $4,000. The letter also stated that this tree had problems (it hit the building before) years before we even owned the property. We were never told of this problem when we bought the house. The tree looked healthy before the storm.
Since we did not know this information before, do we have some sort of rights because of it?
What is the best option in settling with the insurance company, especially if we do not have $4,000 or even close to it?
