I will try to make this short. I bought a home in NC.
My realtor stated the atty. will hold 3x amt. for repairs on rotted bathroom floor after inspector found damage. I closed, trusting her honesty.
Living in Ohio, I could not assess situation.
Seller lied on disclosure. Sellers agent admits they knew problem existed.
I now have estimates over $4000. Amt. held for me was only $1700.
I have proof of damage, & statements from 2 contractors regarding problem was long standing & need for total gutting of floor to hall & bedroom.
Seller hired contractor to fix, but was equilivent of a bandaid on a hemmorage to hide true damage.
1. Should I file in small claims court and sue ALL involved?
2. Should I hire an Atty?
3. Should I ask sellers agent to contact seller and try to settle out of court?
(My realtor is of no help at all!)
