What is the name of your state? Virginia

When a deed is titled John Doe, et ux, when John Doe gets divorced, does the Et Ux become void? My friend is getting a divorce and his estranged wife has never seen this house, she lives in Texas, nor did she sign any paperwork for the closing or the mortgage. Does a quit claim deed need to be submitted to the courts or is she off the deed at the time of the divorce.

A person who is on a deed stays there until that interest is gotten rid of by a judgment in a lawsuit (e.g., a divorce decree) or by that person conveying his or her interest either while alive or by the deceased person's representatives.

Q: Does a quit claim deed need to be submitted to the courts or is she off the deed at the time of the divorce.

A: Neither; if husband wants wife off the deed after the divorce, he needs to have her sign a quit claim deed to him and he needs to record it in the land deed records of the county where the real property is located. He may have to pay her some money.
