little backround.. My boyfriend had seizures years ago after a head injury in military. He has been without seizures for 7 years and has not needed medication for past 5.

Last week while working (hes a delivers office supplies) he slipped going up the stairs with handtruck hitting his head. A few days latter he had a surgery. The doctors say with siezures theres no way to say 100% that the accident is cause for the seizures to return. His employers insurance company is saying that it a proir condition and since doctor could not state definate the accident was cause, they have no responsibility to him having seizures every few days now.

Right now hes pretty hard to talk to because is being depressed from hell, worriny about losing driving rights and having to go back on the medicine that made him miserable for so many years.

Is workers comp on solid legal ground here?

In my opinion yes they are right, they are not responsible for the seizures.. Seizures can come and go and this being prior to the current injury it is hard to prove wrong..

You need to talk with a attorney that is experianced with this type of case because your boyfriend may be able to claim to workers comp. that the injury aggrivated his prior condition.
