Try to keep it simple and short.....
ex and i broke up - i want to keep the house, she and i agreed on a price for equity payoff, she stopped paying mortgage and moved out saying that i owe everything until refi is done, i want to know, can i deduct the missing payments from the payoff - she says no and now wants a partition and says i will have to pay for it since she is filing it. is this right? I thought that since she is the one dragging her feet and being uncooperative, the judge would take that into consideration and not have me pay her lawyer/filing costs. please enlighten me...

thanks
