What is the name of your state? Texas

My husband was hurt at work 2 weeks ago. He was in a tower in a chemical plant when a trey in the tower fell on him and hurt his back. They have taken him to there doctor and of course there is nothing wrong with him. He has talked to workmens com and is having a VERY hard time getting a hold of them to set up an appt to go see his own doctor. Meanwhile he is at work and his employeer is trying to make him got back to full duty. He has not seen his own doctor yet. Can they by law make him go back to full duty before he sees his own DR? They know that all he is waiting on is WC to call him back with the approvial to go to his own dr for a second opinon. Is this allowed by law in the state of Texas?

If the WC dr released him for full duty, then he has a job to do. What he wants to do on his own time, or take sick time, is up to him.

Your husband can go see a doctor of his choice - before or after he has been released to full-duty by the company doctor. The carrier doesn't need to make the appointment for him. He can make the appointment and his doctor's office will only need to verify with the carrier that a report of injury has been filed. Just make sure that his choice of doctor's is on the approved doctor's list. Just ask the doctor's office, they should know. (This is assuming the company is Texas workers' comp subscriber. If they are a non-subscriber - meaning they do not have workers' comp insurance, which is legal in Texas - he will have to dance to their tune.)
