Hello,

We purchased a house in Ohio a year ago. We have had 2 things happen:
1. we had the chimneys/fireplaces professionally inspected and they are unusable, repair cost is ~ $10,000
2. we recently received an assessment from the township for $5300.

The seller's disclosure form said there was no damage to the fireplaces or chimeys yet they knew there was (dampers were bad so they stuck insulation in to keep the drafts out) and they also knew about the assessment (we have the documents now that prove it and they admitted when we asked them about it recently) yet the disclosure form said no assessments.

Do we have a valid argument to try and recover these costs ? The title search, after I went back and reviewed it just recently, did mention the assessment but not in $ terms of this nature, however through circumstances we did not know this at the sale. Also, the realtors paid to have a damper installed in one of the chimneys, but not the other, and both have significant heat tile cracks and deficiencies, hence not being able to use them.
