What is the name of your state?California

We hired a photographer named Carlos Voss in Sept 2004 to photograph our wedding in Hawaii. We few both Mr. Voss and his assistant to Hawaii and paid for their airfare, hotel, and car. We also paid him our agreed upon amount after the wedding was over.

Since then we have tried calling and emailing him trying to get our finished album. He has avoided returning our calls though we have left a message with a family member on two occassions. Our contract does not specify a date which he needs to have our album to us, but at this point we are more interested in getting our money back since he will probably just do a crappy job if forced into sending us something.

Do we have any recourse with this guy? Is our only option small claims court?

Small claims court is your best option but what is the limit for your state? This sounds like it might have cost quite a lot.

Sometimes a letter from an Atty on their letter head will bring a response too.

You have no basis on which to sustain suit. If there was no delivery date then the photographer is not yet in breach of contract.
