I am considering a business plan which will include giving technical analysis of individual stocks and buy/sell/hold recommendations via phone, and charge on a per minute basis.

I am a former licensed stockbroker (expired series 7 & 63 licenses).

What I need to know is if I have to be registered to give investment opinions. I will not be managing client accounts or selling securities.

Information I have read online is unclear about this.

I reside in New York State.

Your best bet - check with the Securities and Exchange Commission and speak with a corporate law attorney in your state about possible state restrictions.

I can't find a direct law in New York State. But as the home of Wall Street there must be laws addressing this. I am sure a New York corporate law attorney would know.
