My parents live in OH and they had a bad storm where shingles on the roof of the house and garage were blown loose. They had a roofing contractor come out and survey the damage and give them an estimate. His estimate states that this was "storm damage" and my parents filed a claim with the insurance company they have had for 40 years. A week later my father passed away. While we were dealing with the funeral and everything that had to be taken care of the insurance company sent out an "independent roofing contractor". We were not at home but a friend of the family was there. This contractor reinserted the shingles and then took a picture of the roof. Then he reported to the insurance company that this was not storm damage. He also advised that there was "granule separation" on the shingles. Unfortunately my mom does not have pictures of when the shingles were blown loose.
The contractor from the original roofing estimate remembers being on the roof and the shingles being out. He did not replace them because he knew that the claims adjustor would need to see them out. He also stated that he knew that there was another layer of shingles under these and that made it less likely that the roof would leak with the shingles being out.
I believe that the insurance company is unfairly denying this claim and perhaps even preying on her bereavement. The agent they have had for years just retired and in my mom's words the new agent was "nasty" to her on the phone. The roof was replaced less than 16 years ago. My mom can find the invoice from the job but it does not state the length of the warranty on the shingles. My mom thinks they were warrantied for 25 years. The invoice states the cost/square of the shingles and my mom remembers where they were purchased so it may be possible to research the warranty with the seller. Looking on the internet it seems as if the minimum shingle warranty is 20 years.
How can I help my mom? (I live 550 miles away.)
