Roof Damage Claim Denied

My parents live in OH and they had a bad storm where shingles on the roof of the house and garage were blown loose. They had a roofing contractor come out and survey the damage and give them an estimate. His estimate states that this was "storm damage" and my parents filed a claim with the insurance company they have had for 40 years. A week later my father passed away. While we were dealing with the funeral and everything that had to be taken care of the insurance company sent out an "independent roofing contractor". We were not at home but a friend of the family was there. This contractor reinserted the shingles and then took a picture of the roof. Then he reported to the insurance company that this was not storm damage. He also advised that there was "granule separation" on the shingles. Unfortunately my mom does not have pictures of when the shingles were blown loose.

The contractor from the original roofing estimate remembers being on the roof and the shingles being out. He did not replace them because he knew that the claims adjustor would need to see them out. He also stated that he knew that there was another layer of shingles under these and that made it less likely that the roof would leak with the shingles being out.

I believe that the insurance company is unfairly denying this claim and perhaps even preying on her bereavement. The agent they have had for years just retired and in my mom's words the new agent was "nasty" to her on the phone. The roof was replaced less than 16 years ago. My mom can find the invoice from the job but it does not state the length of the warranty on the shingles. My mom thinks they were warrantied for 25 years. The invoice states the cost/square of the shingles and my mom remembers where they were purchased so it may be possible to research the warranty with the seller. Looking on the internet it seems as if the minimum shingle warranty is 20 years.

How can I help my mom? (I live 550 miles away.)

This won't help much, as I write policies, not handle claims. But I can tell you this. The 25yr warranty is on shingle life while on the roof. NO manufacturer or contractor will warranty against shingles being removed from the roof due to any act of nature. The shingle staying on the house is only as good as the nail holding it down. ok u want to help your mom. im a insurance restoration specialist and i can help you. The first thing you need to know is that insurance companies do not like to have to pay. So get ready to write this down. First of all that contracter she signed up with needed to know what he was doing. You need to find a respectable insurance restoration contractor. prefer a local one that has a alright BBB score( I'll explain the score thing in a minute). Whatever Contractor you choose will need to know the storm date from the old claim and have a new storm date ready and make the insurance call WITH you and ur mom. They will have an adjuster call you to give YOU a date and time that they will be there. NOW THIS IS VERY IMPORTANT....WHEN THE ADJUSTER CALLS YOU YOU CALL THE CONTRACTOR AND GIVE HIM THE TIME AND DATE THE ADJUSTER IS GOING TO BE OUT THERE AND MAKE SURE HE GETS ON THAT ROOF WITH THEM AND GETS THEM TO BUY THE ROOF AND GUTTERS AND ANYTHING ELSE THAT HAS DAMAGE. Now,listen to me let that contracter do his job. take that how ever u want. Something else for you know the city codes that are in affect like drip edge, metal in the valleys of your roof, water n ice shield, 25 to 40 year shingle etc...the contacter u sign up with should know them all but it is an idea for u to know also..... Once the roof has been bought the insurance will depreciate the roof and will give u anestimate and cut two checks. THEY WILL BE WRITEN OUT TO THE POLICY HOLDER BUT THAT ISNT YOUR MONEY GET THAT PART STRAIGHT BEFORE U SIGN UP WITH A CONTRACTER ITS THE CONTRACTERS TO DO THE JOB. THE FIRST ONE WILL BE USED TO GET MATERIALS AND FOR SOME OF THE LABOR. After ordering the materials and labor the contractor will have to come out of pocket for the rest until the jobs coomplete and has been inspected and everything is up to code and your happy with the job then they will invoice the insurance company and they will release the second check to the policy holder and the contracter will pick that up as well and the job is complete. Now 1 more thing and listen closely. The policy holder is required by insuranc law to pay their deductable. The deductable will be payed to the contractor from the policy holder directly after the job is complete. IF YOUR CONTRACTOR HAS TOLD YOU THAT HE WILL PAY THE DEDUCTABLE HE HAS COMMITED INSURANCE FRAUD. There are ways that he can help you with coupons or refferal programs that is totally legal. And their are other ways also if he is willing to do so like returning ur old gutters to you instead of getting new ones put on and return that money to you that could be used to pay on your deductable but i would say pay the deductable they should have payment plans and 500 to 1000 dollars isnt bad for a new roof and gutters and possibly a discount on your monthly payment for insurance not to mention the added value to your home. You are dealing with one of the most valuable assets of your life after all.

HOw much sand or grit or whatever that is, is still left on the shingles? Even if there was a *25* yr warranty doesn't mean that they would last for 25 yrs. I am NOT an adjuster but imo as an agent, I have found these type roof claims will not pay 100% to replace the roof and will only repair the damaged shingles (shingles that have blown off and damage from only those shingles). The shingles are more than half worn out and they were replaced on the roof.
