I operate a small academic tutoring service and I am considering hiring an employee to serve some additional clients, but I have concerns over accident liability. The potential employee may have multiple tutoring sessions scheduled per day and would be required to drive to and from clients' homes using his or her own vehicle. My specific concern is whether I could be held liable if the employee gets into a car accident while in transit to or from a session.

The employee would be paid per session-hour and would not be paid explicitly for time spent travelling between sessions. There may however, be some form of compensation for travelling expenses, either through a distance-based reimbursement, or through gas and toll receipts.

Under these circumstances, could I be held liable for damages resulting from a car accident?

I appreciate any advice.

Yep.

You are in BUSINESS. Pay the few bucks (business expense) to get a local attorney to review your circumstances and see if an indemnification agreement would be appropriate. And if so, to provide one.
