crazy situation,,need advice

What is the name of your state?VIRGINIA My wife works for a very large international company as a part time, non-union part time surervisor fro 21 years. She has had 2 back surgeries since 2003 and has been off work for recovery both times, but has returned under doctors restrictions. The last time in January 2005. The end of april 2005 her manager told her to do a job which is union and against her doctors orders, she told him so and he verbally attacked her. she filed a complaint and about a month later eh called her in and told her she was being put out on disability. She called human resources and they never had a clue she was ever out of work or had the previous surgeries. They also applied on her behalf for disability, but it was denyed, they tried to back date it. The complaint guy has told her they are not going to accomodate her, and they say she doesn't meet accomodations under the ADA. Well its been 3 1/2 months now and she has always recieved her full pay, and will for a year. they have said she was done wrong, but not taking any action .The company process in not moving anywhere and they have not made an offer for a severence package, we are waiting it out. they have turned her complaint into her medical situation and not addressing the complaint. Its getting confusing and flustrating. Are we on a good track right now. we have retained an attorney but have no case till they do something. The company has accomodtaed her for 2 years, and let her return to work, the manager never forwarded any notice of her being out to human resources, till after the April incident. Any advice out there, I know this takes time but help. thanks all

If you have an attorney, he or she is in the best position to advise you. I presume if a violation of the ADA or the FMLA had taken place, he would have told you so and filed a complaint with the EEOC or DOL.
