Forgive the question but-- what is the difference between civil litigation and small claims court. Can a case be both?

Small claims court is part of the civil court. It has limits in each state to how much you can sue a person for and what type of cases that can be brought there.

For example, malpractice claims, probate cases, support or alimony from a marital or a domestic dispute case can't be filed in a small claims court.
