Some months ago I signed a "noncancellable" equipment lease agreement for a software program enabling me to process customer credit cards in my business. The original offer I responded to was a mail order offer. Since signing the agreement, I have experienced a major decrease in my business (I was led to believe I could expect to see a 40% or better increase). Subsequent to signing the agreement I received policy statements from the major credit card companies that effectively make it impossible to continue to process customer credit cards. Finally after using the software for some months it developed a glitch which made it impossible to continue processing the cards. The software company refuses to provide tech support except at a rate of payment that together with all the other charges effectively make it impossible for me to continue using the software. I have subsequently stopped processing cards, returned the software and challenged the contract on the basis that it was breached by the makers. I live and have my business in Missouri. The lease company is in New York.
