My fiance was assaulted by a coworker while on work premises and both were on the clock. Charges were pressed and my fiance filed worker's comp due to having two severe cuts on his head and lip, resulting in the need for sutures. His employer has suspended him and as told him he is possibly going to be terminated. They have also told him that they may keep him and the assaulter, fire them both or keep only one of them; yet to be determined. Can they legally fire him for being assaulted and not fighting back to any extent?
