I am in Maine and was wodering if I can file a Malpractice suit against a doctor for delaying medical progress by not attempting to resolve the issue. All he does is ask if anything has changed and the tells me to come back in six weeks. He also said I was fine to use my right thumb and in the past few days, doing so has started to cause excessive pain. He also cleared me for work with no limitations even though holding, grasping or manipulating items causes high levels of discomfort in my hand. This in turn caused my performance to lack due to my inability to perform at my job and my subsequent dismissal from my employer. Basically seeking if this falls under the guidelines for malpractice.

You have no case here. In your other thread you stated you are being referred to specialist. Though you have to wait to see the specialist, you have been referred. Haven't you applied for unemployment?

Still have case pending with possible denial due to former employer making false unverified accusations. Major reason for dismissal was "not working up to par".

Instead of making a bunch of threads on this, why don't you wait and see what happens.. Also how is he dening you help or prolonging it?

Doctor has MISDIAGNOSED!!!! He was claiming I had a thumb neurethheria (nerve damage), but it is tedinitis! I have had to deal with this for four months when it is something he could have treated already! He told me tostop using my brace and the doctor I just saw immediately told me to wear a brace. what can I do now?

yes it is. Doctor misdiagnosed and in turn prolonged the discomfort by doing this.
There is little difference between some of these diagnosis and depends on what clinical signs were presented initially, it can change over time and may take a very long time to heal. Have you been using RICE? Consult a worker's comp attorney re your options.
