I have been on workers' compensation receiving a check weekly. I had surgery on 7/29/05 for a torn rotator cuff. The doctor had me able to return to work but with restrictions since 6 weeks after my surgery. The problem is there is no work for me. I am an agency nurse and we can not go into a facility with work restrictions.

Today, I received a letter where the workers' comp. representative is decreasing my income benefits due to the doctor stating I can return to work with limitations. The limitations are 0lbs lifting, no pushing/pulling, no climbing, and no overhead lifting.

I want to know if it is legal for him to decrease my weekly check when there is no work for me. My employment agency has said there is no work for me, also.
