I was hit by a drunk driver with no license and he was driving a friends car the friend had insurance but the driver did not I only had no fault no collision on my car it was totaled I know i can get 500.00 from the mini tort law but I want to know if I can take the driver to small claims court for the value of the car 3000.00 dollars or do I have to sue the owner of the car.
