Can a judge refuse to appoint a public defender? IF you are entitled to a public defender, there is only one way a judge can refuse you a public defender: when you already have an attorney and you want to switch to a public defender but it is too close to trial, the judge may refuse.
It also depends on the seriousness of the charges. If, for example, it is a speeding ticket, you have no right to appointed counsel. And the judge's view of your ability to afford counsel may be different from yours, especially if you want the "dream team".
this is basically a consitutional issue and would best be answered by a criminal defense attorneyit comes down to whether or not the state is seeking jail. if the state wants to you in jail, they they have to appoint an attorney represent you.
