Is anyone familiar with case law regarding how former employees can solicit confidential customers of their former employer if they obtain the contact info from an independent source?
i.e... Two friends work @ a rip-em-off mortgage company. (Highest rates & fees anywhere).
Friend #1 tries to do a refi & cash-out for her personal friend/babysitter.
The rates and fees are not attractive enough to the babysitter and she wouldn't get all of the cash-out that she wants. Babysitter declines the offer.
Friend #2 quits working for the rip-em-off mortgage company.
A couple of weeks later, friend #1 refers her babysitter/personal friend to friend #2 who now works @ a new mortgage company that doesn't rip people off and can get the babysitter a lower rate, fees & all the cash-out she wants.
Babysitter refi's w/ Friend #2.
Friend #1's employer (rip-em-off mortgage) accuses friend # 1 of divulging a trade secret by refering her babysitter/personal friend to Friend #2 @ a new company, because Friend #1 previously pitched rip-em-off's product to the babysitter.
