What is the name of your state? Pennsylvania, Carbon County.
On September 16th 2005 I received an arbitration award in the amount of $12,000.00 plus some personal property. Since that time I have not received any payment towards the $12,000.00 or towards the the payments of $50.00 per month that I paid to keep the loan current. The loan to the defendent was from my home equity line of credit. What do I need to do to make the defendent pay back the 12,000.00 and the additional $1,800.00 (estimated) I paid to keep the loan current? Any advise will be greatly appreciated.

This response assumes that your award was binding and that any appeals options that might have been included in the arbitration agreement have expired or been exhausted.

Neither a court judgment nor a binding arbitration award for money "make" the defendant pay. If the losing party is not voluntarily honoring the award, you must submit the award to a court and have it confirmed as a judgment. Then, you must enforce the judgment, using the rights and the tools that will be available to you.

You don't indicate whether the arbitration was of a state or federal law matter or any of the particulars (the "where, who and what" of the arbitration) and that's fine, but start by looking to the award and the arbitration rules for further guidance.

Thanks for the info. Very soon I will have enough money spent on the case to pay the loan off mysely. I will contact the county court and see if I can take steps myself to settle the case. So much for trying to help a friend.
