Is it illegal to use a co-workers name (first and sirname) in a novel without the co-worker's permission? This is in the state of Texas.

There is no copyright or tradename infringment but may be an invasion of privacy. The illegality issue would stem from what is written in conjunction with the persons' name that could be judged as libel or slander. Is it important to use the persons name? Why not use a fictious name and put a disclaimer ie. the names have been changed for privacy purposes, to protect the innocent etc.
