It's been 2yrs and your now just asking about it?
Were you put at MMI?maxium medical improvement.
Did you recieve a final admission of liability?
Ask yourself these question's, and alittle more info on your situation and
people might be able to answer your question..

(Ohio) There were some complications at the beginning. A week after my injury which was caused by a piece of machinery that has 300lbs of air pressure behind a steel lift plate that exploded in my face, I developed glaucoma in my left eye. BWC kept asking for more medical documentation to allow the added claim. Thank god my glaucoma specialist is a true doctor that cares more about her patients then profit and performed an emergency operation before I went blind. They said they needed to see the casual relationship between my increased eye pressure and glaucoma and my initial injuries which included a corneal abrasion. I guess an impact to your face and eye is real hard to see the casual relationship to getting glaucoma in the injured eye. Well after all their stalling around they finally approved the added injuries and after 14 days with no employer appeals I figured I was finally close to some financial relief. Well now comes the motion for Temp.Total and my employer appeals with copies of their employee post accident drug testing policy. I forgot to mention 18 days after my injury right after I lost vision in my left eye they over the phone terminate me saying I tested positive. That's another story in itself considering the Chain of Custody had initial mistakes which should have caused the lab to refuse to test. Anyway they submitted documents to the IC the day before my hearing without my attorney ever seeing any of them. So we got a continuance. A lot of things are really strange about my ex-employers last minute filing of these documents. For one thing this employer drug policy dated Effective Date January 1 2000 and Revision date October 18 2004 looks nothing like anything in my employee handbook dated 3-1-2000. There's not even anything similar to my November 2002 handbook. All the other pages of the file submitted say revision 3-1-05. Even if this isn't some newly made up document I can't figure where they think it would apply to me since my accident was May 24 2004 and they terminated me on June 11 2004. How could I be held accountable to a document That's quoting current law. As far as I can figure I would be grandfathered under the Ohio law at the time of the accident which was still considered Unconstitutional. Well I could go on and on but I'm starting to put myself to sleep let alone the rest of you wonder people. It felt good to vent a little. I'm starting to get depressed from all this but I don't want to add anything else yet in fear that I'll be waiting another year for the snails at Ohio BWC to make a decision. Oh yea were waiting till after this decision before we file for a VSSR for lock out tag out procedure that I never was trained in. Thanks to all of you that can help with advice or support.
