What is the name of your state?Ma
Recently our in house IS guy inadvertently sent a joke picture that included a nude woman to a printer and as sometimes happens it went to a very wrong printer. This guy was terminated and the main IS guy went through other computers including mine checking for whatever. I asked him if he found anything on mine and he stated no with some stuff that may be questionable violations of policy but not pornographic.
The things that he was talking about were 2- 1 min long clips and by no stretch of the imagination could be considered pornographic. The next day I was put on administrative leave with pay while the GM and HR guy “investigated the pornographic movies on my computer.” I was called in a few days later and terminated for violation of 13.1.34 of the telephone and communication code.
I have been very depressed over this. It is in my written personal folder that I had Pornographic movies on my computer and that is false yet the implication is still there. Do I have any recourse in this matter to get that statement removed from my file?

To have it removed, no. You can request it, but your employer is under no obligation to agree.

However, in MA, if there is something in your file with which you do not agree, you have the right to write out a rebuttal to whatever it is, and your employer is required to put that rebuttal in your file as well.
