What is the name of your state? Illinois
If you are in a state that allows the recording of telephone conversations as long as one of the parties is aware of the recording but the 2nd person is located in a different state that does not allow for telephone recordings unless all parties are aware, which state laws apply or what federal laws apply?

The state where the 2nd party lives...the Law would be Federal Wiretapping.

Is this recording being used as evidence to show guilt or innocence of a crime?
If so, the state where the crime occurred.

it really depends upon in which state the recording is going to be used and which state the recording person is in.
