Battery on an Officer

What is the name of your state? Florida

While defendant was being brought in for booking. He states that the officer began pulling his hair and making comments that he would be a good boy for the other inmates. The defendant then spit on the officer. The report states that the spit hit the chest area. I assume that the officer was dressed in uniform and no skin contact was made. Defendant now faces 3rd degree felony charges, plus two others, what he was initially brought in for... Defendant is 19 yrs of age, no priors. Should he use public defender or try hiring a lawyer? He has no money to hire a lawyer. Thanks for advise.

Skin contact is irrelevent - the spitting is battery ... he needs an attorney.

What kind of advice are you expecting? There is not a whole lot that can be provided for this as the incident would be very fact-specific.
