To whom it may concern,

Today is my Birthday and the only wish I have is letting the public know that Cory Eastlick, an innocent man who was arrested February 1, 2005, has now spent 330 days in the Plattsmouth County Jail, has yet to go to trial for a “False Allegation”. This has been fabricated by several people to protect the most overlooked an obvious suspect (Child’s biological father). The State admitted in a Motion to Limine the prior sexual behavior that they had no physical evidence to support this allegation, as well as a statement made by the child to Children’s Hospital that she denies any previous or recent sexual abuse/inappropriately touching.
Here are several key unanswered questions:
Jeff Steinhauer deposition carefully describes using his daughter as bait to catch Cory Eastlick. Would you put your 8yr old daughter out as bait for a person to assault her again? Why is Investigator Schenck giving so much creditability to Jeff Steinhauer? Jeff Steinhauer was not considered a prime suspect. Jeff Steinhauer was convicted for assaulting his 5yr old daughter wouldn’t this cause the investigator to really look at him even closer?
How can this possibly be happening for the 2nd time to Cory?
1. How is it that 50yrs to Life sentence not put on Mr. Breen’s Priority List?
2. How can and advocacy Program help my brother when an obvious lack of concern for the value we offer this case is of no concern? He excuses himself of these actions implying his overwhelming case load .
3. We believe this information should have led to filing an important Motion, “Motion for a Taint Hearing”. See attachment.

Cory affirms and requested your Commission to inform us of the strategy being used in his defense. We have brought this to your attention, seeking your help in getting Mr. Breen back on the right path with Cory’s case. Who shall we hold responsible if the one person Mr. Breen (who can get Cory exonerated) will not do his job, and his profession demands that he gives the best Defense Possible to Cory Eastlick.

We need to get this story out to anyone who will look into our concerns and questions to this case. This is a very complicated case that desperately should be looked into regarding these employees’ failures to see the “Red Flags”.

That's not unusual. Many forms of molestation don't leave any physical evidence. Other times, it's not reported soon enough.

No. But that doesn't mean Jeff didn't.

I don't know. Did they? What are the state protocols for investigating a "Child Sexual Abuse?" To whom do they apply? And if someone, somewhere, didn't follow a protocol - what effect, if any, would it have on Cory's trial?

Two suggestions: 1.) Take this letter to someone who knows how to write, before you send it anywhere, and 2.) find out whether sending this letter (to whoever you're going to send it to) could be of any conceivable help to Cory.

I did. My impression is she knows virtually nothing about the law, and what little information she does have comes from day-time television, and the website of a private investigator (who charges $1250/day for his services, and whose mo involves promising the sun, the moon, and the stars to potential clients.)

She wouldn't (I hope) follow her mechanic into the shop to instruct him on how to fix her car. But she thinks nothing of telling Cory's lawyer how to do his job, even though she's clueless.

Clue #2: Statement from Tina (18yr old) who the child first disclosed.

On Wednesday Jan 26, 2005 Me & Lucy where watching La Bamba & a part came across that said “when we have sex” its like raping her. Then Lucy started giggling so I had asked her what was funny & she said sex. I was like why is that funny that I didn’t know what it was. She said she did so I told her to explain it to me & she said she’d get introuble. I said no, just tell me because I wanna know. So she goes it’s when a guy & girl get naked together, he sucks on her nipple & he puts his weenie in her second hole & it sometimes happens in the shower & they suck on each other. I was like oh okay then told her I wouldn’t tell then told my mom & she ended telling my mom @ dinner & we were in shock from her knowing so much. Then my mom left for the gym & had talked to my uncle about that. So meanwhile me & Lucy sat on floor while I put her hair up for school. Then I had remembered she said she watched some of this sex stuff with Phillip (the babysitter.) So I thought why would a grown man watch with a 9 year old. So I asked Lucy did you & Phillip ever do anything, she goes what do you mean I was like, did you do anything. She goes well, we have a secret. I said, “What do you mean a secret”. She says, I can’t tell. So I took her off floor & walked into the bathroom & sat down w/her & go Lucy is there something your not telling. Then it took me about 5-10 minutes before she goes we had sex. Immediately I cry & freak out & run & tell my dad but tell him not to say anything to her. I couldn’t get ahold of my mom cause she was @ gym so I called my sister Teresa & told her & then she called my mom cause they were meeting there anyway to work out. Then I walked back to bathroom & said what else she said he put it in her butt & well I was like that why she can’t go pottie a lot. Then I asked her what else as I took her to my bedroom & she goes well he made me suck on him & he sucked on me But she said she didn’t suck on him long because she thought it was grosse & then they tongue kissed. I asked how many times she said at least four & once dad came home. Later on I had asked her if it hurt she said not 1st time but 2nd, she cried & screamed to stop. Then I explained rape to her from movie. She said the reason it happened was they were watching porn & she asked what it was & then he told her when he was little he did it with an older lady. Then I asked her why she didn’t tell her mom (Jackie) & dad (Craig). She said she did so I was freaking out. She said she had told Megan (her little sister) & she told her mom & then Jackie questioned her & she said no & then told the truth & then Jackie said she’d tell her dad. Later on that nite Lucy says she went to her dad & asked if mommy told him & he replied tell me what. She said she went nevermind & dropped it. The entire time I was crying lucy asked whats wrong am I gonna die I just replied it’s bad your a little girl it's not suppose to happen to you & she was like if I didn't ask what was going on it never would of happened & I just replied not it's good to ask questions but you shouldn’t have been around it. But she doesn’t realize whats wrong with it. So I try to talk to her about it. But she’s really set on her mom knowing & that they didn’t do anything.

There was someone on this thread who spent considerable time responding to you, and had some questions for you. Yet, you chose to ignore that work, and the questions.

As a result, we don't care, so don't bother. Everyone who was accused of child abuse will be imprisoned for life. Get used to it!

Answers to first questions.....

based off the heresay statements as well as the Dr from Children's Hospital did the full rape kit and found nothing to show any sexual abuse happened. And when the doctor asked the 9yr old she said she has never been sexually abused or touched inappropriatly recently or previoulsy.

The behavior was that the 9yr old admited to her 18yr old cousin, her foster parents that her and her 5yr old sister were sucking on each other and putting there fingers in there second hole. As well as the 9yr old was being treated for sexual victimization prior to her disclosure on Jan. 26.

Here are 2 Letter for my reasons.

I would like to register a complaint about Sally Kaplan (LCSW, Forensic Interviewer). Ms Kaplan performed a Forensic interview on January 31st, 2005 on patient N.S. #3740. In our investigation, we discovered evident statements, which demonstrate her to be incompetent, not to mention a liability to Project Harmony. While being deposed in this legal matter, Ms Kaplan reveals a disregard for procedural and moral obligation.
In the provided attachments, Ms Kaplan provides ample evidence of neglecting the obvious procedures. Here is one example of many in the following attachment:
Ms. Kaplan briefly describes what forensic interviews involve and gives the general outline. In the outline, she mentions and I quote “you begin by assessing a child’s development and establishing some rapport with that child”. Prior to her general description of a forensic interview, Ms Kaplan stated the following and I quote “What George and Earl told me was that N. was in foster care with an aunt and uncle due to physical abuse by her father, and that while watching television with her sister and, I think, foster sister she had stated that she knew what sex was because Cory had sex with her. That’s pretty much the only background I had before I started the interview”. It seems very apparent that she’s uninformed to what’s vital of an assessment based on her failing to perform anything of the sort. Unless she defines this only prior background an assessment. She freely admits that she knows very little of any prior background and decides to proceed without any trepidation or apprehension. The obvious fact is that there was really no assessment done.

Letter 2 Motion I put in to Get Mr Breen.

COMES NOW CORY LEE EASTLICK, DEFENDANT, ACTING ON HIS OWN BEHALF, UNABLE TO AFFORD COUNSEL, REQUESTING THIS HONORABLE COURT GRANT HIM AN ORDER TO DISMISS CURRENT COUSEL. THE DEFENDANT CITES THE FOLLOWING IN SUPPORT OF HIS REQUEST:
1. COUNSEL FAILED TO PRESENT ANY KNOWN WITNESSES FOR DEFENDANT
A Failed to procure or consult an expert witness that would provide alternative strategies.
B Ms Ann Babb is defendants’ fiancée. She’s an ideal witness to corroborate for the defense. Ms Babb’s eagerness to aid and add testimony has been continuously disregarded by current counsel. Counsel cunningly takes advantage of Ms Babb’s lack of knowledge in order to delay counsel questionable actions. He has misled Ms. Babb to believe there is no probable option that she be a credible witness for the defense.
C. Mr. Bob Shonka is defendants’ employer and was on the list of witnesses. Upon my request, my sister Shannon Field spoke with Mr. Shonka on June 29th via telephone. Mr. Shonka was willing to give testimony and/or statement upon request. Up to that time, Mr. Shonka informed her that there had not been any inquiry affiliated to this case.
D. Dr. Rochelle Caruso is a Physician at Children’s Hospital. Dr. Caruso was the first Physician to give a complete examination of the alleged victim. According to the investigation, this occurred on January 26th, 2005. The Expert Witness testimony of Dr. Caruso would be valuable to the defense. Her examination on the alleged victim found there to be no physical evidence. Furthermore, it was noted by Dr. Caruso and I quote “the patient denies any recent or past sexual abuse and/or inappropriate touches”. Counsel had overlooked Dr. Caruso as a defendant’s witness. Counsel gives no explanation or underlying strategy for his act.
E. Barbara Haru was the Registered Nurse and assisted Dr. Caruso throughout the examination. She for the same reasons as the Dr. Caruso would be added as the defendant’s witness.
2. COUNSEL IS INCOMPETENT
A. Issues involved in this case are complex and beyond the scope of the Public Defender David V Chebatoris legal knowledge. He is not aware of current court decisions including the use of “Taint Hearings” in child sexual abuse cases, per his own admission.
B. Mr. Chebatoris failed to consider or procure an expert, for use at trial or for use in preparation of cross-examination of the State’s witnesses and abandoned all inquiry into proper interviewing techniques.
C. Mr. Chebatoris failed to contact any witnesses, file specific motions request by myself, or to challenge the reliability of the victim’s prior disclosures.
D. Counsel fails to object to the obvious. For example, during the deposition of alleged victim, she has a concern for her constipation and asks if this is due to the assault. The reply “I don’t know? I’m not a doctor, but it could be…” by prosecution not only is it speculative; it is absurd, unbelievable, and an insult to the honorable court. Worst yet, It’s goes unreciprocated that the alleged victim has a real sincere concern of health.
E. Mr. Chebatoris failed to hire assistance or conduct any adequate, pretrial investigation, not even to pursue the freely submitted evidence uncovered by Shannon Field, Louis Villanova, and Laura Threw due to financial limitations placed on him from the State of Nebraska
3. COUNSEL IS UNTRUSTWORTHY
A. Mr. Chebatoris failed to use any of the available evidence including, and not limited to the Videos and medical record evidence such as the Children’s Hospital staff acting as agents of the police, as the accused true testimony during initial hospital visit dated January 26,
B. Mr. Chebatoris stated that the victim’s word was believable, even though it is not substantiated by the medical evidence.
C. Mr. Chebatoris has expressed doubt about my innocence during a phone call on August 8, 2005.
4. COUNSEL PROVIDES POOR COMMUNICATION
A. Mr. Chebatoris has not returned my phone calls or letters in a timely and professional manner.
B. Communication with Defendant is that of only which is deemed as “Absolutely Necessary” is not adequate and reasonable representation. The fact that counsel has up to this time avoided contact to discuss strategy for trial is inexcusable.
5. APPOINT OF NEW COUNSEL BY THE COURT WOULD ASSURE THE DEFENDANT OF A FAIR TRIAL.
6. THE ENDS OF JUSTICE WOULD BE BEST SERVED IN THIS MATTER IF DEFENDANT WAS GRANTED THE RELIEF REQUESTED.
7. DUE TO THE FACT I’M INCARCERATED AND EVIDENCE IS NOT READILY AVIAILABLE TO ME, I HAVE GIVEN POWER OF ATTORNEY TO THE MOST COMPETENT PERSON I KNOW, MY SISTER SHANNON FIELD ON JULY 1, 2005.
WHEREFORE, THE DEFENDANT REQUESTS THIS HONORABLE COURT GRANT THIS MOTION TO HAVE CURRENT COUNSEL DISMISSED AND NEW COUNSEL APPOINTED.

Project Harmony, Sheriffs Office, Lutheran Family services are all in one building together. They don't want to subject the child to telling the story over and over...

And if someone, somewhere, didn't follow a protocol - what effect, if any, would it have on Cory's trial?

It would show they arrested the wrong one when they never did the full assesment that should of been done....
