Not given a Breathalyzer

So a friend of mine had a party in NC and the cops showed. The cops told my buddies dad either he could take the rap for aiding and abetting to his son or everyone at the party would get the breathalyzer. I know a few people probably would not have passed if they had to take it. The dad chose to take aiding and abetting to his son. As far as I know, the son had not had anything to drink that night. Can he get this ticket dismissed because the son never took a breathalyzer and therefore was not proved to be drinking?

What does a breathalizer have to do with any of this?

Why do you think proof of drinking is necessary to the cops' case?
