I was rear-ended on 12/28/05, and the insurance company (as well as two seperate bodywork specialists) have called the car a total loss.

I had an additional inspection done, and the person said that even if someone were to replace the rear clip & entire back end of the car, it would be structurally unsound and unsafe in another accident-even if it was bumped at 5 mph.

To give you an idea-the entire back end is crumpled to the point where the rear underpart of the bumper is pressing the gas line against one of the back tires, and the metal is digging into the tires. Also, the back doors will not open on either side.

Since I agreed to settle and let the insurance company take the car (for salvage/parts, I thought) they actually told me that they intend to repair the car and sell it again as driveable.

What I want to know is what I can do to make sure people are aware of the extent of the damage and unsafety of the car before the title is no longer in my name?

There is a police report regarding the accident, which is supposed to automatically be reported to CarFax, etc, but I really don't trust it.

I hate the thought that someone might buy the car to drive, thinking it's repaired enough to be safe, and then have them hurt or killed. I wouldn't drive that car again if it looked brand new, knowing the damage it's had.

It sickens me to think that the insurance company might downplay the damage and sell it to someone who won't be aware of the danger.

What can I do?

Do you have all of this in written form? If so, send copies to your state insurance board, the state attorney general, and the BBB.
