My ex and I have 4 kids, we split them so we both have deductions. My question is: Since one of my sons is college age, I cannot claim him for EIC. Is there any problem with me claiming one of the kids my ex claims on his taxes (he doesn't qualify for EIC). Would doing so mess up his filing? Thank you for any help.

If he is a full time student, you can claim him for EIC. If not, you can claim one of the others for EIC, provided you meet the qualifications.

It will not screw up your ex's return as long as it is done correctly.
