What is the name of your state?NY. My husband is in the military right now in Texas and i live in NY. We need to file jointly but I am not sure if we need to be present at the same place in order to do this. Can we sign the form and then send it to the next person to sign... How does this work? Thanks.

I believe you can have the files prepared and then have the other person sign in front of a notary. Or give your husband a Power of Attorney ;) Im in the military too by the way, and i had my wife give me a POA when she was away from me.

Contact JAG for help with powers of attorney. BTW, talk to a NY tax pro about whether your husband is still considered a NY resident. Many states have laws that a resident who joins the military remains a resident until s/he takes positive steps to establish residency in another state.
