Hi my name is Hal and I am from New Mexico,

I had a judgement filed against me in 1987 by Allstate Ins. Co. My question is: In the state of New Mexico what is the Statue of limitations for a judgement? I have not heard anything in 13 yrs and have never had my wages garnished.
Nor is it on my credit report anymore. Also what are the chances of it showing up again? The reason for my questions are because I am persueing a career in Law enforcment. Thanks

My response:

Very interesting questions, Hal.

First, judgments are good for up to 20 (twenty) years; however, the key words are "up to".

If a creditor fails, within the first 10 years, to renew their judgment, then they don't get the second 10 years. You can find out by going to the Court's archives and looking up your case. Take a peek at the file to see if Allstate ever renewed their judgment. If they didn't, you're in the clear.

If they haven't collected from you up to this point, it's highly doubtful they will try, especially if they failed to renew the judgment.

This information is, assuming of course, that the judgment wasn't entered in another State, and that you haven't moved.
