If your claim was denied & then your appeal was also denied, you may seek legal assistance & also, if you wish, get in touch with the Dept. of Labor concerning your rights under ERISA. Once an appeal is denied, you can take action at once. You should have received a written explanation in a manner you can understand as to why the appeal was denied. If you believe you still qualify for benefits, you can pursue it further as I indicated. You have at least 60 days (plan may provide you with more time) to appeal after a claim is denied. After an appeal is denied, I would assume you also have at least 60 days to take legal action.
